Terms of Service

1Acceptance

By creating an account or using HexCoded (the “Service”), you agree to these Terms and our Privacy Policy. If you use the Service on behalf of a business, you confirm you're authorised to bind it. You must be 18 or older.

2What the Service does

HexCoded generates AI ad videos for commerce. Brands provide a product link, reference, or template and select actors (AI actors or licensed real actors); the Service produces ready-to-run video ads. The underlying AI models are operated by us and our vendors and are not exposed to you.

3Accounts

  • Sign-in is via Google or email (no passwords). You're responsible for activity under your account and for keeping access secure.
  • One person/business per account unless we agree otherwise. Provide accurate information.
  • We may suspend or terminate accounts for breach, fraud, or risk to the Service or others.

4Credits, billing & refunds

  • The Service runs on credits. Billing and payment are processed by Dodo Payments as Merchant of Record — Dodo is the seller of record for your purchase, issues your invoice, and handles applicable taxes.
  • Credits are deducted when a generation succeeds. If a generation fails for a technical reason, the held credits are returned to your balance.
  • Credits and purchases are non-refundable, except (a) the technical-failure return above, or (b) where required by law or by Dodo's policies. A successful render you simply don't like still consumes credits — there is no satisfaction refund. Full refund/cancellation terms: Refund & Cancellation Policy.
  • Plans, top-up packs, prices and credit costs are set in-product and on our pricing page, and may change prospectively. Top-up credits are valid for 12 months from issue; plan credits follow the published plan terms.

5For actors (likeness licensing)

If you onboard as an actor and create an AI twin of yourself, your relationship with us is governed by the Actor Licence — the binding document you accept at onboarding. In short: you license your face, voice, and display name for AI ad generation; you earn for every paid brand use; you can stop new use anytime; content already generated and delivered to brands survives. If anything in these Terms conflicts with the Actor Licence, the Actor Licence controls for actors.

6For brands (use of generated content & actors)

  • Subject to payment, you receive a licence to use the ad content you generate, including any licensed real-actor likeness in it, within the scope below. The licence for delivered content is perpetual.
  • Scope of use — digital only. You may run the content as paid ads and organic posts on online platforms, and on your own websites and apps. Television, print, outdoor/billboard, or other offline use requires a separate written agreement with us.
  • Edits. You may make light edits — trimming, cropping, captions/subtitles, music, end-cards. You may not re-generate, morph, re-voice, or otherwise alter an actor's face or voice outside HexCoded.
  • You are responsible for your ads — the claims you make, the products you advertise, compliance with advertising laws (e.g. ASCI in India) and platform policies, and any required disclosures (see §8).
  • Don't use an actor's twin outside the licensed scope above.

7Acceptable use

You will not use the Service to: break the law; impersonate real people without rights/consent; create deceptive, defamatory, hateful, sexual-of-minors, or harmful content; infringe IP or personality/publicity rights; mislead consumers; or attempt to reverse-engineer, overload, or abuse the Service or its credit/billing system. 8AI-generated content

Output is generated by AI and may contain errors or artefacts; we don't warrant it is accurate, suitable, or fit for any particular campaign. You are responsible for reviewing output before use. HexCoded does not label or watermark output; any AI-disclosure labelling required by law or by the platform where you publish (Meta, YouTube, etc.) is your obligation as the publisher. See the AI-Content Disclosure.

9Intellectual property

  • The Service, its software, models access, templates, and brand are owned by us/our licensors.
  • As between you and us, you own the product inputs you provide and the final ad outputs you generate, subject to the licences in these Terms and the Actor Licence. Actors retain their personality/publicity rights in their likeness except as licensed.
  • You grant us a limited licence to process your inputs/outputs to operate, secure, and improve the Service — including using brand inputs and generated outputs to train and improve our models and services. You can opt out anytime by emailing support@hexcoded.ai; we'll exclude your workspace's content from training going forward.
  • Actor biometrics are different. An actor's face/voice data is used only to build and operate that actor's own twin — never to train general AI models (see the Actor Licence). We also don't give your content to third parties to train their foundation models.

10Disclaimers & limitation of liability

The Service is provided “as is”, without warranties to the maximum extent permitted by law. To the extent permitted by law, our aggregate liability is limited to the amount you paid us in the one (1) month before the claim, and we are not liable for indirect or consequential losses.

11Termination

You may stop using the Service anytime. We may suspend/terminate for breach or risk. Sections that by nature should survive (IP, licences already granted, disclaimers, liability, governing law) survive termination.

12Governing law & disputes

These Terms are governed by the laws of India; courts at Gurugram, Haryana have jurisdiction.

13Changes

We may update these Terms; material changes will be notified in-product or by email. Continued use after changes means acceptance.

Actor Licence

The short version. Brands can use your AI twin in ads made on HexCoded. You earn every time a paying brand uses it — the amount for each render is shown in your dashboard. You can stop new use anytime; ads already made and delivered stay valid. And your twin is locked to your verified face — only you can license it, and we prove that to brands. The sections below are the full terms behind those four lines.

1What you're licensing to us

When you complete onboarding and tick the agreement box, you grant HexCoded a non-exclusive, worldwide licence to use your submitted likeness — your face, your voice, and the display name you choose (together, your “Twin”) — to generate and deliver AI ad videos for brands on HexCoded, on the terms in this document.

  • Non-exclusive means your face stays yours: you're free to work with anyone else, on any other platform, at the same time.
  • Your display name is the first name or stage name you pick at onboarding. Brands see it when casting. We never show your full legal name.
  • You confirm the Twin is of you, that you're 18 or older, and that you have the right to grant this licence.
  • You also confirm that the photos, videos, and recordings you submit are yours to license — they don't infringe anyone else's rights (for example, a photographer's copyright in a photo of you), and granting this licence doesn't breach any other contract you've signed (agency, brand-ambassador, union).
  • You also allow us to show your Twin profile (photo, display name) in the actor library that brands browse, and in HexCoded's own marketing of the platform. You can ask to be excluded from marketing anytime via support@hexcoded.ai (the library listing is how brands find and cast you).

2Verification — a condition of this licence

Onboarding includes a liveness check and a face-match (see our Privacy Policy) to confirm the face is really yours. Publishing your Twin is conditional on passing it. When a brand casts your Twin, we show them a “consent verified” receipt — proof that a real, verified person agreed to this licence. If the face or voice you submitted is not yours, this licence is void from the start (see §7).

3What brands may do with your Twin

Brands generate ad videos with your Twin only through HexCoded, and may use those videos:

  • as paid ads and organic posts on online platforms, and on their own websites and appsdigital use only. TV, print, outdoor, or other offline use is not included and needs a separate agreement.
  • with light edits only — trimming, cropping, captions, music, end-cards. Brands may never re-generate, morph, re-voice, or otherwise alter your face or voice outside HexCoded.
  • for as long as they like — the licence on a delivered video is perpetual (see §5 for what “stop” means).

Content generated with your Twin must comply with our Acceptable Use Policy — no adult content, no deception, no hate, no illegal goods. That floor applies to every brand, always.

4What you earn

  • You earn every time a paying brand uses your Twin to generate content. There is no fixed rate card; the amount for each video/render is shown in your dashboard, at the time of use.
  • Earnings are counted in USD. How the money reaches you depends on your country and is shown in your dashboard (in India: UPI). Payouts are made manually per the payout terms in your dashboard, and require identity/tax verification (KYC) once you reach the payout threshold.
  • What you've earned is yours: accrued earnings never expire and are never re-priced.
  • We may change what future uses earn, with notice — changes are never retroactive.
  • If a brand's payment is later reversed (for example a chargeback or refund), the matching earnings are adjusted from your balance.

5Your control — stopping use

  • You may stop new use of your Twin at any time, from your dashboard or by writing to support@hexcoded.ai. It takes effect promptly: no new videos will be generated with your Twin.
  • Videos already generated and delivered to brands stay valid and may continue to run — stopping is not retroactive. This is what brands rely on when they pay.
  • Stopping use doesn't affect earnings already accrued (§4).

6Your data — face, voice, and what we keep

  • Your face/voice data is used only to build and operate your own Twin — never to train general AI models.
  • Your consent record (the tick, with time and date) is kept permanently, as proof that consent existed.
  • Your master face/voice recordings are kept only while any brand content made with your Twin remains licensed; after that they are deleted.
  • Details, your rights, and our Grievance Officer: Privacy Policy.

7Ending this licence

  • You leave: stop new use (§5) and, if you wish, delete your account. Delivered content and your accrued earnings are handled per §5 and §4.
  • If you pass away: your legal heirs may ask us to stop new use of your Twin by writing to support@hexcoded.ai; any unpaid earnings are paid to your estate as applicable law allows.
  • We terminate you for breach (of this licence or the Acceptable Use Policy): no new use of your Twin; delivered content stays licensed; earnings you legitimately accrued are still paid out.
  • We may pause your Twin (temporarily stop new use) at our discretion — for example during a dispute, suspicious activity, or a risk review. Earnings you've already accrued are unaffected.
  • Fraud is different: if the Twin was not you, this licence was never valid — content is taken down where we can reach it, and associated earnings are forfeited.
  • If a promise you made here turns out false (the Twin isn't you, or the materials weren't yours to license) and that costs us or a brand money, you cover that loss.
  • Sections that by nature survive (delivered-content licences, consent records, earned amounts, governing law) survive the end of this licence.

8Your status

You are an independent participant — not an employee, agent, or partner of HexCoded. Nothing here creates an obligation for us to generate any minimum number of videos or earnings. You are responsible for your own taxes on earnings, under the law of your country or region; where law requires, we deduct or withhold tax before payout (for example, TDS in India).

9Changes to this licence

We may update these terms; material changes will be notified to you (in-product or by email) and apply prospectively — never to content already generated or earnings already accrued.

10Governing law & contact

This licence is governed by the laws of India; courts at Gurugram, Haryana have jurisdiction. Questions or misuse reports: support@hexcoded.ai.

1Scope

This policy covers personal data we process for brands (buyers), actors (who licence their likeness under the Actor Licence), and visitors to our site.

2Data we collect

All users: name, email, Google account identifier (sign-in), device/usage/analytics and advertising-measurement data, support messages.

Brands: the product links/content/references you submit; workspace and team info; billing data is collected and processed by Dodo Payments (our Merchant of Record) — we receive transaction status/metadata, not full card details.

Actors (sensitive — read §3): the photos/video you upload for your AI twin; a voice recording used to create your twin's voice; a liveness capture and a selfie used for face-match; the consent acceptance record (the Actor Licence clickwrap you tick, with timestamp/IP); your chosen display name; earnings records; and, only when you reach a payout, identity/tax details required for your country (e.g. PAN in India) for payment and compliance (KYC via Didit).

3Biometric / sensitive personal data (actors)

  • To confirm a twin is really you, we process a liveness check and a face-match between your selfie and your submitted twin, using AWS Rekognition as a processor. Your voice recording is processed by ElevenLabs to create your twin's voice.
  • This is biometric/sensitive personal data. We process it only with your explicit consent, captured at onboarding via the Actor Licence clickwrap, for the specific purpose of identity verification and building/operating your twin.
  • Use limit: your face/voice data is used only to build and operate your own twin — never to train general AI models (see Terms §9).
  • Retention: your consent record is kept permanently as proof that consent existed. Your master face/voice recordings are kept only while any brand content generated with your twin remains licensed, then deleted or irreversibly anonymised.
  • You can withdraw consent (see §6); withdrawal stops future processing and new generations, but does not affect content already lawfully generated/delivered (see the Actor Licence).

4How we use data

To provide and secure the Service; verify actor identity; generate and deliver ad content; calculate and pay actor earnings; process payments (via Dodo); provide support; comply with law (tax, grievance handling); and improve the Service — including training our models on brand inputs and generated outputs (opt out anytime via support@hexcoded.ai). Actor face/voice data is never used to train general AI models (Terms §9, Actor Licence), and we don't give your content to third parties to train their foundation models.

5Who we share it with (processors & recipients)

  • Dodo Payments — billing/payments (Merchant of Record), taxes/invoicing.
  • AWS (incl. Rekognition) — hosting, storage, liveness/face-match.
  • ElevenLabs — voice cloning for actor twins (we host the generated audio; models receive signed access, never a public link).
  • Didit — actor identity/KYC verification at payout.
  • AI model vendors (e.g. video generation providers) — to render content; we send the inputs needed to generate, not your account identity beyond what's required.
  • Analytics/observability (e.g. PostHog, Sentry) — product analytics, session recording, and error monitoring.
  • Meta (Meta Platforms) — advertising measurement via the Meta Pixel and Meta Conversions API; we share ad-event data and hashed identifiers only (never your plain-text email, name, address, or payment details). See §10.
  • Auth (Clerk/Google) — sign-in.
  • Legal/regulatory recipients where required.

We do not sell your personal data.

6Your rights

You may request access, correction, completion, updating, or erasure of your personal data, and may withdraw consent, by contacting our Grievance Officer (§12). We'll respond within the timeframes required by law. Actors can be located anywhere (the Service accepts actors globally); rights under your local law (e.g. GDPR where it applies) are honoured per that law.

7Retention

We keep personal data only as long as needed for the purposes above or as required by law (e.g. tax/payment records), then delete or anonymise it. Biometric verification data and twin recordings: see §3.

8Security

We use reasonable technical and organisational measures (encryption in transit, access controls, secrets management). No system is perfectly secure.

9Data location & transfers

We host primarily in the United States (AWS us-east-1) and use vendors that may process data outside India.

10Cookies, analytics & advertising

We use essential cookies and product analytics (e.g. PostHog) to run and improve the Service.

Advertising measurement (Meta). We use the Meta Pixel and Meta Conversions API to measure the performance of advertisements shown on Meta platforms (Facebook, Instagram). This helps us understand which advertisements led to sign-ups and purchases so we can improve ad relevance and reduce wasted spend. Data shared with Meta includes page views, sign-up completions, and subscription activations, and — in hashed (irreversible) form only — your email address and account identifier. We do not share your plain-text email, name, address, or payment details with Meta. You can opt out of Meta advertising tracking through your Meta account settings.

Session recording. We use PostHog to record product-usage sessions in our app for internal debugging. Sensitive input fields (e.g. passwords and payment forms) are automatically masked and never leave your browser in plain text.

11Children

The Service is for users 18+. We don't knowingly collect data from minors.

Refund & Cancellation Policy

The short version. HexCoded runs on credits. Credits are only deducted when a video successfully generates. If a generation fails for a technical reason, the held credits are returned to your balance automatically. Beyond that, purchases and used credits are non-refundable, except where the law or our payment provider (Dodo) requires.

1Successful generations

Credits are consumed when a generation completes successfully. A finished video you simply don't like still consumes credits — there is no satisfaction refund (you choose your inputs before generating; review them first).

2Technical failures

If a generation fails for a technical reason on our side, the held credits are returned to your balance automatically. This is a credit return, not a cash refund.

3Credit purchases & subscriptions

  • Credit top-ups and subscription plans are non-refundable once purchased, except as required by law or by Dodo's policies.
  • You can cancel a subscription's renewal anytime; cancellation stops future charges. Remaining credits remain usable until they expire per the terms below.
  • Top-up credits are valid for 12 months from issue. Plan credits follow the published plan terms.
  • Plan changes don't generate refunds. Upgrades apply immediately — you pay the pro-rata difference for the rest of your billing period and receive the matching credits. Downgrades take effect at the end of your current period, so nothing is owed back either way.

4Billing provider (Merchant of Record)

Payments are processed by Dodo Payments as Merchant of Record. Chargebacks and certain refund requests are subject to Dodo's processes and applicable consumer law; we cooperate with Dodo to resolve them.

5Statutory rights

Nothing here removes refund rights you have under applicable law (e.g. for billing errors or non-delivery).

6How to ask

Using HexCoded, you agree not to use the Service to create, generate, or distribute content that:

1Is illegal or harmful

  • Breaks any applicable law or regulation.
  • Promotes violence, terrorism, self-harm, or illegal goods/services.
  • Sexualises minors in any way, or depicts non-consensual sexual content.

2Misuses people's likeness

  • Impersonates a real person without their rights/consent.
  • Uses an actor's licensed likeness outside the licensed scope (see the Actor Licence and Terms §6 — digital use only, no altering face or voice).
  • Creates deceptive “deepfakes” of real individuals to mislead, defame, or defraud.

3Deceives or harms consumers

  • Makes false or unsubstantiated advertising claims, or violates advertising standards (e.g. ASCI in India) or the policies of the platform where you run the ad.
  • Is defamatory, harassing, hateful, or discriminatory.
  • Infringes intellectual property, trademark, or personality/publicity rights.

4Abuses the Service

  • Attempts to reverse-engineer, scrape, overload, or disrupt the Service or its models.
  • Circumvents or abuses the credit/billing system, usage limits, or security controls.
  • Uses the Service to build a competing model or dataset.

5Your responsibility

You are responsible for the ads you generate and how you use them, including required disclosures (see the AI-Content Disclosure). HexCoded provides the tool, not clearance of your campaigns.

6Enforcement

We may remove content, suspend, or terminate accounts that violate this policy, and report unlawful activity to authorities. Serious or repeated violations end access without refund.

7Reporting

Report misuse (including misuse of an actor's likeness) to support@hexcoded.ai.

1What HexCoded makes

HexCoded generates AI-created video ads. Videos are produced by AI models from your inputs (a product link, reference, or template) and the actor you choose — an AI actor or a real actor who has licensed their likeness to be used this way.

2Real actors are consented and licensed

Every real-actor likeness on HexCoded is there because that person gave explicit, verified consent (identity + liveness checked) and accepted the Actor Licence. Actors can stop new use of their twin at any time. We do not allow likenesses of people who haven't consented.

3AI output — what to know

  • Output is AI-generated and may contain errors or artefacts. Review every video before you use it.
  • We rely on our model providers' safety filters for output safety; there is no separate quality “verification” badge.
  • The video depicts a performance generated by AI, not a real recording of the actor saying those words in that setting.

4Disclosure & labelling — who does what

  • HexCoded does not add AI labels or watermarks to output.
  • You, the brand, are the publisher — any AI-disclosure labelling required where you publish is your obligation: by law (e.g. India's IT Amendment Rules 2026, or local AI-transparency rules) or by the platform (Meta, YouTube, etc., many of which provide their own AI-content toggles).
  • Label based on where and how you use the content — the requirements differ by platform and country.
